1. Who we are
Swalfy is an AI WhatsApp receptionist for businesses, built and operated by Al Daim Digital Ltd, a company registered in England and Wales (company number 17327688), Oxford, United Kingdom. We are not affiliated with, endorsed by, or part of Meta Platforms, Inc. or WhatsApp. You can reach us at hello@swalfy.com.
2. Accepting these terms
By creating an account or using Swalfy, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service. You must be authorised to accept these terms on behalf of your business.
3. What Swalfy is
Swalfy connects to a WhatsApp Business number you already control. It reads incoming messages, text or voice, in Arabic, English, or Urdu, drafts and sends replies, proposes and books appointments, and records leads, so you can see the outcome of every conversation.
Replies, translations, and bookings are produced automatically by AI systems. They are usually accurate but can contain mistakes; you are responsible for checking anything important before relying on it.
4. Connecting WhatsApp and Meta's rules
You connect your own WhatsApp Business number through Meta's Embedded Signup. You are responsible for keeping that connection in good standing and for following WhatsApp's own Business Messaging Policy.
Free automated replies only work inside WhatsApp's 24-hour customer service window. Sending marketing or broadcast messages outside that window uses paid message templates and is a separate feature (available on our Pro plan), and you are responsible for having your customers' consent (opt-in) before sending them, as WhatsApp's rules require.
5. Your customers' data
You are the data controller for the messages your customers send to your WhatsApp number; Swalfy processes that data on your instructions, as described in our Privacy Policy. You are responsible for having a lawful basis to process your customers' messages, for your own privacy notice covering your WhatsApp channel, and for the content your business sends through Swalfy, including that it is lawful and does not infringe anyone's rights.
6. Your account
Keep your login details secure. You are responsible for activity on your account and must tell us promptly if you think it has been used without permission. Give us accurate information about your business.
7. Content and ownership
Our software, branding, and the Swalfy name belong to Al Daim Digital Ltd or our licensors. You keep ownership of your own business content — price lists, menus, messages you send — that you upload to or send through Swalfy; you grant us a licence to process it so we can run the service for you.
8. Acceptable use
Use Swalfy only for your own business. Do not resell or share access beyond the seats included in your plan, attempt to break, overload, or reverse-engineer the service, upload unlawful or harmful content, use Swalfy to spam or harass anyone, or use it in a way that breaches WhatsApp's or Meta's policies. We may limit, suspend, or close accounts that breach these terms or put our WhatsApp access at risk.
9. Plans, payments, and cancellation
Swalfy is billed monthly through Stripe, in USD (with AED and SAR shown at checkout where available). Prices are shown before you pay. You can cancel at any time; your plan stays active until the end of the period you have paid for, and we do not give pro-rata refunds for partial periods.
Broadcast messages on the Pro plan are billed as the pass-through cost of WhatsApp's own message templates plus our margin, on top of your subscription.
10. The service is provided "as is"
We work hard to keep Swalfy accurate and available, but we provide it "as is" and "as available." To the fullest extent permitted by law, we do not guarantee that the service will be uninterrupted or error-free, or that any AI-generated reply, translation, or booking will be accurate. Swalfy also depends on third parties, including Meta's WhatsApp platform, which we do not control.
11. Limitation of liability
To the fullest extent permitted by law, Al Daim Digital Ltd is not liable for any loss or damage arising from your use of Swalfy, including lost bookings, lost messages, missed appointments, or any indirect or consequential loss. Where we are found liable despite this, our total liability to you is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under law, including for death or personal injury caused by negligence, or for fraud.
12. Ending your use
You can stop using Swalfy and delete your workspace at any time. We may suspend or end your access if you breach these terms, if your WhatsApp connection is removed or restricted by Meta, or if we stop offering the service. Sections that by their nature should continue — content and ownership, disclaimers, limitation of liability — survive.
13. Changes to these terms
We may update these terms. We will change the date above and, for significant changes, tell you by email. Continuing to use Swalfy after a change means you accept the updated terms.
14. Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If any part is found unenforceable, the rest still applies. For any question, email hello@swalfy.com.
